BOCCE PARTICIPATION WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT

Please read carefully. This is a legal document affecting your legal rights.

In consideration for being permitted to participate in bocce activities at the Italian American Club of South Brevard, Inc. ("Club"), I agree as follows:

VOLUNTARY PARTICIPATION

I understand that participation in bocce activities, including but not limited to league play, tournaments, practices, lessons, social play, demonstrations, and related activities, is entirely voluntary.

I certify that I am physically capable of participating and assume full responsibility for my decision to participate.

ASSUMPTION OF RISK

I understand and acknowledge that participation in bocce activities involves inherent risks, including but not limited to:

• Slips, trips, and falls;
• Uneven, loose, wet, or changing court surfaces;
• Injuries caused by bocce balls or other equipment;
• Collisions with participants, spectators, or objects;
• Muscle strains, sprains, fractures, and other physical injuries;
• Weather-related conditions;
• Entering, exiting, or walking near the bocce courts;
• Any other known or unknown risks associated with participation in bocce activities.

I knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with my participation in bocce activities and my presence on or near the bocce courts and related areas.

RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the Italian American Club of South Brevard, Inc., its current and former officers, directors, members, employees, volunteers, committee members, agents, representatives, successors, assigns, and insurers (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, liabilities, costs, expenses, or attorney's fees arising from or related in any way to my participation in bocce activities or my presence on Club property, including claims arising from the ordinary negligence of any Released Party.

HOLD HARMLESS AND INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Released Parties from and against any claims, actions, suits, damages, liabilities, costs, or expenses, including attorney's fees, arising out of or related to my actions, participation, conduct, or presence at Club bocce activities.

MEDICAL TREATMENT

I authorize the Club and its representatives to obtain emergency medical treatment on my behalf if deemed necessary.

I understand and agree that I am solely responsible for all medical expenses, transportation expenses, and other costs arising from any injury or illness I may sustain.

COMPLIANCE WITH RULES

I agree to comply with all Club rules, regulations, safety requirements, and instructions.

I understand that failure to comply may result in suspension or removal from bocce activities.

FUTURE PARTICIPATION

I understand and agree that this Waiver, Assumption of Risk, Release of Liability, and Indemnification Agreement shall remain in effect for all current and future participation in bocce activities conducted, sponsored, authorized, or hosted by the Italian American Club of South Brevard, Inc. from the date of signing forward.

I acknowledge that I am signing this Agreement once and that it applies to all future participation in bocce activities unless revoked in writing by the Club.

FLORIDA LAW AND VENUE

This Agreement shall be governed by and interpreted under the laws of the State of Florida.

Any legal action relating to this Agreement shall be brought exclusively in a court of competent jurisdiction located in Brevard County, Florida.

SEVERABILITY

If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDMENT

I acknowledge and agree that:

• I have carefully read this entire Agreement;
• I understand its contents;
• I understand that I am giving up substantial legal rights, including the right to sue;
• I am signing this Agreement freely and voluntarily;
• No oral statements or representations have been made to me that alter the terms of this Agreement;
• I intend for this Agreement to be legally binding upon myself, my heirs, personal representatives, estate, and Assigns.
